Sindh High Court, in a landmark decision, has deemed the regularisation of contract employees in Grade 16 and above without commission’s examinations as illegal.

The Sindh High Court (SHC) ruled on Friday that it is unlawful to regularize contract workers in grades 16 and up without requiring them to pass commission exams.

The Sindh High Court’s two-member bench, presided over by Justice Nadeem Akhtar, rendered a decision declaring it unlawful to regularize contract workers without having them pass the commission’s exams.

The court stated that after their contracts expire, contractual officers are not eligible to request permanent appointments.

The court declared that there is a clear mechanism in place for the appointment of personnel in grades 16 and up. Chief Secretary (CS) Sindh was directed by the court to submit the list of workers who were regularized without having to pass the commission’s examinations. The court also mandated that all officers promoted to Grade 16 and higher who had been regularized without taking commission tests have their regularizations revoked.

The NAB has recommended that the province government adopt “administrative corrective measures” in accordance with the law and consider the “evidence” included in the reference against 22 illegal appointees.

Additionally, it referenced rulings from the Supreme Court from 2011 and 2015, respectively, which said that “regularization of illegal appointments” was not warranted.

The NAB recommended that the Sindh Public Service Commission be the exclusive source for officers in grades 17 and 18, in accordance with the legislation.
