The Lahore High Court (LHC) Justice Ali Baqir Najafi on Tuesday heard Shehbaz Sharif’s miscellaneous petition and dismissed the objection of the Registrar’s Office on the application against the non-implementation of the orders to allow the PML-N president go abroad.
The court has ordered to present the petition before the concerned bench for regular hearing.Justice Ali Baqir Najafi of Lahore High Court heard the objection raised on the petition of Shehbaz Sharif. The DG FIA and Home Secretary have been made parties in the petition filed by Shehbaz Sharif.The petition was filed by Shehbaz Sharif’s lawyers Amjad Pervez Advocate and Advocate Azam Nazir Tarar.
The petition urged, “Lahore High Court allowed Shehbaz Sharif to go abroad and the Deputy Attorney General of Pakistan was also present in the court.”
“The court had issued the order in the presence of the public prosecutor but the court order was not complied with,” said Azam Nazir Tarrar Advocate.He said that insulting comments were also made on various TV shows despite court order.
Justice Ali Baqir Najafi remarked, “Your application has been admitted in the court only as an objection. The Registrar’s Office has objected to following the court order and referred it to the relevant forum for implementation.” “If there is a need to execute an order, there will be no need for contempt of court, “Amjad Pervez Advocate argued.
He further said that the court order was simply blown up.After this, Justice Najafi remarked, “The court does not know whether the court order was blown up, if that happens then the law will make its own way.”The petition pleaded that despite the court orders, Shahbaz Sharif was not allowed to go abroad.“A contempt of court petition was also filed against the concerned officers for violating the court orders,” the petition reads.
The federal government had filed a review petition in the Supreme Court of Pakistan (SCP) against Lahore High Court single bench order to remove Shehbaz Sharif’s name from the blacklist.On Monday, the federal government through the Interior Minister pleaded with the apex court to declare the May 7 order of LHC as ‘null and avoid’.“Position of the Lahore High Court’s court cannot be upheld in the eyes of the law,” the review petition reads. “The LHC did not ask for any report or reply from the concerned authorities as there is no guarantee that Shehbaz Sharif will come back. Shehbaz Sharif is the guarantor of Nawaz Sharif’s return,” the petition reads.The Interior Minister said that Shehbaz Sharif’s wife, son, daughter and son-in-law are already fugitives.
The review petition was made by Shehbaz Sharif and FIA parties. “Shehbaz Sharif’s name was in the Provincial Identification List (PNIL). The Lahore High Court provided final relief without issuing notices. Lahore High Court’s permission to go abroad is not justified,” the petition reads.The Interior Ministry petition reads, “The single bench of the Lahore High Court (LHC) ignored the facts and the decision was given unilaterally.”
